The Quality of Use Policy governs the publication of commercial advertisements by users on Clickcool Company Supports.                 

The Advertiser is responsible for the content of his advertisements and he undertakes to respect the legislation in force of his country in this matter and in particular the rules hereafter.                 

In addition, the publication and distribution of an Ad on Clickcool sites implies the full and complete acceptance of this Quality Charter For Users by the Advertiser.                 

Lastly, the Clickcool Company reserves the right to stop broadcasting the Announcement, if the Advertiser does not comply with all or part of the regulations in force, the GTC, the TOS and / or of this Quality Charter of a good user of the Clickcool Company, without this giving rise to the Advertiser's right to any refund or indemnity.

2.1 Writing and Content of Ads                 

All announcements must be written in the Clickcool languages ​​(English, French, German, Italian, Romanian), with the following exceptions:                 

                        
  • Denominations of typical products and foreign specialties known to the public. Example: jeans;                     
  • Foreign names protected in your country as a result of international agreements;                     
  • Terms or expressions used in everyday language or resulting from the application of international conventions and in the case of goods or products with engraved, molded or woven inscriptions in foreign languages. Example: made in;                     
  • Trade names, corporate names, or signs;                     
  • Trademarks, trade marks or service marks.                 
                

The Advertiser will not be able to simultaneously display several ableds with identical content. For this purpose, the Advertiser agrees to delete any old ads with the same content as the new ad published.

The Advertiser will be considered a Professional Advertiser if all or some of the criteria listed below are met:                 

                        
  • The Advertiser buys and / or creates products or services for resale;                     
  • The volume and frequency of sales or services provided by the advertiser is significant and short-term;                     
  • The advertiser achieves a turnover higher than the threshold authorized by the law of residence of his country or the regulation because of this activity of sale or service delivery                     
  • The Advertiser keeps for a short time the products it acquires before reselling them;                     
  • The sales or services provided by the Advertiser are made for profit.                 
                

In this case, the Advertiser must comply with the regulations applicable to professionals. Otherwise, its Ads will be rejected.

Finally, the Announcement must concern a single property or a single lot of goods of the same nature or a single service. The description of the Ad must describe only and precisely the property or the lot of goods of the same nature or the service mentioned in the advertisement.                 

2.2 General Prohibitions                 

2.2.1 Prohibitions Concerning the Form of the Advertisement                 

It is forbidden to publish:                 

                        
  • Announcements exclusively written in foreign terms;                     
  • Advertisements mentioning or describing several goods or services or having terms not related to the proposed content;                     
  • Advertisements that directly or indirectly direct the Users of the Advertisement to a site with competing content or to a competing establishment and / or whose content is contrary to the regulations in force;                     
  • Ads containing a url address;                     
  • Ads inserted into a category that does not match the subject of the Announcement;                     
  • Same Announcement (identical good or service) with different postal addresses or postal codes.                     
  • Multiple ads with the same content

2.2.2 Prohibitions on Ad Content
                

It is forbidden to publish Ads whose content:                 

                        
  • Is misleading or in particular to false, exaggerated or excessively advantageous, relative information, without this list being exhaustive, to the price, description and / or characteristics of the product or service .                     
  • is contrary to the material or moral interests of the Company and in particular:                         
                                  
    • Political content;                             
    • Discriminatory, offensive or denigrating content;

    • Religious content;                             
    • Content contrary to decency or morality;                             
    • Content likely to shock readers such as sexual, pornographic, violent, racist content, etc.;                             
    • Copies of goods or counterfeits;

Examples :

  • Advertisements for the sale of "copies of CDs, DVDs, video games";                     
  • Advertisements relating to the sale of clothing, footwear, accessories, having great similarities or similarities with a well-known mark.                     
  • The object is property that the Advertiser would not be authorized to sell, particularly in the event of an irregular acquisition. In this regard, the Company reserves the right to ask the Advertiser the invoice for the purchase of the property offered for sale or any other evidence relating to the property;                     
  • The purpose of applying for membership or registration is either to require the payment of money or to expect financial gain from registration or the hiring of third parties;

The specific rules below are intended to guide the Advertiser when writing their ad and are for informational purposes only.                 

They do not replace the obligation of the advertiser to be aware of the regulations applicable to the content of his advertisement before any broadcast of it.                 

The responsibility of the company Clickcool will in no case be engaged because of the application of these rules by the Advertiser and especially in case of misinterpretation.                 

In addition, the Advertiser is fully aware that the rules listed below can not be exhaustive.                 

3.1 Category Auto / Motorcycle                 

Any advertisement related to the sale of a motor vehicle (car and light truck) must indicate:

  • the date of first entry into circulation;                     
  • the make of the vehicle;                     
  • the model of the vehicle;                     
  • the type of vehicle;                     
  • the version* of the vehicle;                     
  • the color of the vehicle;                     
  • and, if applicable, the variant* of this model;                     
  • the price of the vehicle: this price corresponds to the total amount including VAT that will have to be paid by the buyer. The price quoted must match the vehicle represented in the Ad;                     
  • the type of energy (for example, gasoline, diesel, ...);                     
  • the transmission (for example, manual, automatic, ...);                     
  • the number of doors;                     
  • the month and year of the first entry into circulation;                     
  • mileage;                     
  • the technical control.

All the Advertisements, for the purpose of selling or renting a property for an energy performance diagnosis, must mention the classification of the property with regard to its energy performance.

In sales Ads, the Advertiser must indicate :

  • The type of property concerned,                     
  • The surface of the property                     
  • The situation of the property                     
  • the sale price including tax of the property. The following are prohibited: ads with a price of $ 0, or ads for which the price display differs between the title of the ad and the body of the ad text;                     
  • the energy classification of housing:                     
                              
    • the energy label indicating the annual energy consumption of the dwelling on a scale from A to G, according to the DPE established by a professional                         
    • the climate label indicating the annual impact of energy consumption on greenhouse gas emissions on a scale from A to G, in accordance with a professional DPE.                     
                        

In rental ads, the Advertiser must indicate :

  • The type of property concerned,                     
  • The surface of the property                     
  • The situation of the property                     
  • the sale price including tax of the property. The following are prohibited: ads with a price of $ 0, or ads for which the price display differs between the title of the ad and the body of the ad text;                     
  • the energy classification of housing:

3.4 Category Services

Any advertisement for a service offer or service request must:                 

                        
  • be written in French. Where there is no term in French to designate the service offer, the French text must include a detailed description so as not to mislead readers particularly on the characteristics of the service, the remuneration and the location of the service.                     
  • be dated;

    3.5 Category Animals

    Advertisements relating to the sale of dogs and / or cats for sale must comply with the relevant legislation. Advertisers must fill in their ads in the Professional or Breeder category. In this case, the Advertisers must indicate in particular their SIREN number.                 

    Exceptionally, announcements relating to the sale of dogs and / or cats by breeders who yield a single litter per year and the scope of which is entered in the herd-book recognized by the Ministry in charge of the may be displayed on the Site in the Private category, provided that the Advertisements comply with the relevant legislation. Advertisers must indicate the range number.                 

    Cat and / or dog giveaway ads may be displayed by a particular Advertiser in the Private category.

    3.5.1 Dogs / Cats

    Any advertisement for the purpose of selling for sale dogs or cats must mention the elements provided by the legislation in particular in Articles L214-8-1 and R214-32-1 of the Rural Code and Sea Fishing:

    • the age of the animals;                     
    • the identification number of the animal, OR                     in the absence of an identification number of the animal, the identification number of the female that gave birth to the animal and the number of animals in the litter;                     
    • the sex of the animal;                     
    • the existence or absence of registration to the LOF or LOOF;                     
    • in the event that the animal is registered in a pedigree book recognized by the Ministry of Agriculture, the breed;

    The publication of an offer of assignment for free must explicitly mention the character of donation or free.                 

    It is forbidden to offer for sale, purchase, or donation of dogs belonging to 1st class attack dogs in accordance with the applicable legislation and regulations, and in particular the following dogs:

    It is forbidden to propose for sale, for purchase, for donation:                 

                          
    • any announcement relating to the sale of animals of which the species is protected or threatened is prohibited. Example: boa constrictor, crocodile, marmoset, gray parrot; Hermann's turtle.                     
    • any announcement relating to the sale of animal fur of which the species is protected or threatened is prohibited. Example: leopard, wolf, lynx.

    3.6 Category Goods

    Ads related to this category must comply with the rules listed above in the article General Prohibitions

                    

    3.7 Pros Business Category

                    

    This category is intended for professionals and consists of advertisements concerning the sale or rental of property used in the context of a professional activity.
